THE ENNERDALE TRADE MARK ORDINANCE (COURT
LEET)
Bailiwick and Liberty of
Ennerdale
Enacted by the Court Leet and Baron in
lawful session assembled
PREAMBLE
Whereas the Court Leet of the Bailiwick and Liberty of
Ennerdale, being a court of ancient custom, franchise, and
local jurisdiction, possesses the authority to regulate trade usages, market practices, and the conduct of
persons within its liberty;
And whereas it is desirable to establish a
system of local trade name, service mark, business signage, trade mark
registration and protection, grounded in customary law and
the good governance of commerce within the said Bailiwick;
Now therefore, the Court Leet doth ordain as
follows:
SECTION I — SHORT
TITLE
This Ordinance shall be cited
as:
“The Ennerdale Trade Mark Ordinance
(Court Leet), Year I.”
SECTION II —
DEFINITIONS
For the purposes of this
Ordinance:
- “Court” means the Court Leet of the Bailiwick and Liberty of
Ennerdale.
- “Registrar” means the officer appointed by the Court to maintain the Register of
Marks.
- “Mark” includes any name, word, symbol, device, seal, insignia, or combination thereof
used in trade.
- “Registrant” means any natural or juridical person entered upon the
Register.
- “Territory” means the Bailiwick and Liberty of Ennerdale and its customary
jurisdiction.
SECTION III — ESTABLISHMENT OF
REGISTER
- There shall be established
a Register of Trade Marks of
Ennerdale.
- The Register shall be maintained
under seal of the Court.

Entries shall include:
- Name of
registrant
- Representation of the
mark
- Date of
registration
- Class or description of
goods/services
SECTION IV — REGISTRATION OF
MARKS
- Any person trading, residing, or
conducting lawful enterprise within the Territory may apply for registration.

Registration shall be granted upon:
- Proof of use or intent
to use
- Payment of prescribed
fee
- Declaration of good
faith

The Court may refuse marks that are:
- Fraudulent
- Confusingly similar to
prior registered marks
- Contrary to morality or
public order
SECTION V — EFFECT OF
REGISTRATION
- A registered mark shall
enjoy exclusive use within the
Territory.

The Registrant shall have standing before the Court
to:
- Restrain
infringement
- Seek damages or
fines
- Petition for seizure of
infringing goods
SECTION VI — USE OF THE SYMBOL
®
- Any mark duly entered upon the
Register may lawfully bear the symbol “®” within the
Territory.

Such symbol shall signify:
- Registration in the Court
Leet Register of Ennerdale
- Protection under the
customs and ordinances of the Court
- Use of the symbol “®”
without registration in the Court Register shall constitute an offense under this
Ordinance.
SECTION VII — ENFORCEMENT AND
PENALTIES

The Court Leet shall have jurisdiction over:
- Infringement
- Passing
off
- False designation of
origin

Penalties may include:
- Monetary
fines
- Confiscation of
goods
- Suspension of trading
privileges within the Territory
SECTION VIII — TERM AND
RENEWAL
- Registration shall endure
for seven (7) years, renewable upon application.
- Failure to renew shall result in
lapse of protection.
SECTION IX — ASSIGNMENT AND
LICENSING

- Such transactions must be
recorded in the Register to be effective within the Territory.
SECTION X — LIMITATION OF
JURISDICTION
- Registration under this
Ordinance shall not confer rights outside the
Territory.

Nothing herein shall be construed to:
- Supersede national or
international trademark law
- Create rights
enforceable in external courts or jurisdictions
SECTION XI — COURT
AUTHORITY
The Court Leet retains full authority
to:
- Interpret this
Ordinance
- Amend its
provisions
- Issue supplementary rules and
procedures
SECTION XII — SEAL AND
AUTHORITY
Enacted under the Seal of the Court Leet of
the Bailiwick and Liberty of Ennerdale,
By authority of the Lord of the Manor and the Homage Jury,
In lawful court assembled.
OPTIONAL ADD-ON (MODERN PRACTICE
CLAUSE)
You may optionally include this clause for
clarity in modern contexts:
“All registrations under this Ordinance
shall be deemed private contractual and customary
rights, binding upon registrants and recognized within
the jurisdiction of the Court Leet and its affiliated institutions.”

Ennerdale, Cumbria — The Bailiwick of Ennerdale today announced the official
adoption of two unique and distinctive Unicode-based symbols for use in trade name registrations within the Bailiwick and for recognition in
international markets.
The first mark, Ⓡ̃ (U+24C7 U+0303), combines the circled letter R with a tilde above, while the second mark, Ⓡ̿ (U+24C7 U+033F), features the circled R with a high horizontal overline. Both
symbols are unique, visually distinctive, and without precedent in any other jurisdiction.
“These marks — Ⓡ̃ and Ⓡ̿ — represent the first-ever adoption of exclusive registration identifiers tied to a specific bailiwick,” said a
spokesperson for the Bailiwick of Ennerdale. “They are a legal and cultural innovation that distinguish our
trade name registry from systems elsewhere in the UK and abroad.”
